01No affiliation with law enforcement

Applied Speed Technologies is a private, independent commercial business. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of any police department, sheriff's office, state agency, or any other law enforcement or government body.

Our equipment is the same class of instrument sold to law enforcement, and we say so because it speaks to the quality of the measurement. It does not imply any official status, authority, or endorsement whatsoever. We have no power to stop, detain, cite, or direct any person or vehicle, and we do not represent ourselves as doing so.

02What our reports are, and are not

A report from us is a record of physical measurements taken with identified instruments under stated conditions, on a stated date. It is provided for the client's information.

It is not legal advice, not expert testimony, not a legal instrument, and not a defence to any citation, charge, or proceeding. We make no representation that any court, prosecutor, insurer, or agency will accept, admit, or give any weight to our findings. We cannot and do not guarantee any legal or administrative outcome.

If you are dealing with a citation, speak to a qualified attorney. We are happy to measure your vehicle; we are not qualified to advise you on what to do about a ticket.

03Scope of a measurement

Results describe the vehicle or object identified in the report, in the configuration it was presented in, on the date of test, under the conditions recorded. Changing tire size, wheel diameter, tire pressure, load, or vehicle software after a test can change the relationship between indicated and true speed, and invalidates the result.

Stated accuracy figures are the manufacturers' published specifications for the instruments used. They describe instrument performance and are not a warranty of any particular outcome for your vehicle.

04Lawful operation, and where we will work

All measurement is conducted from locations that are lawful for us to work from - public vantage points where doing so is permitted, or private property with the permission of whoever controls it. Where a site requires permission or a permit, obtaining it is part of the job and we will tell you if it affects the quote.

We do not encourage, arrange, assist, or participate in unlawful speed on public roads. Clients are solely responsible for operating their vehicle lawfully and safely at all times, and for complying with every applicable traffic law. Any test requiring speeds above the posted limit will be scheduled on a closed course or private property with appropriate permission, or it will not be scheduled at all.

We reserve the right to decline or stop any job we judge unsafe, unlawful, or misrepresented to us, at any point and without refund of costs already incurred.

05We do not operate your vehicle

Applied Speed Technologies does not drive, ride, or otherwise operate any client vehicle at any time. We operate only our own vehicles and our own instruments. Your vehicle is driven throughout by you or by a driver you nominate, who must be properly licensed and insured for it.

That means the person behind the wheel is responsible for how the vehicle is operated - its speed, its condition, its roadworthiness, and compliance with every applicable traffic law. We measure; we do not drive.

We will decline to record a run we consider unsafe, and we may end a session at any point on those grounds.

06Client operation of equipment

Clients may operate our LiDAR equipment during a supervised session. Our lasers are 905 nm Class 1 products and are eye-safe in normal operation; even so, do not stare into the emitting optics, do not aim the unit at aircraft, and do not aim it at any person's face at close range. You will be briefed before the equipment is switched on and you must follow operator instructions at all times.

Clients do not operate the RADAR units. Transmitting on the licensed K and Ka bands is subject to FCC licensing and remains with us.

Participation in a live operation session is at your own risk. A liability waiver is provided and must be signed in person before you handle any equipment - we bring the document to the session. You are responsible for damage to equipment caused by misuse.

07FCC licensing status

Police-type Doppler radar transmits in licensed spectrum and its operation is regulated by the FCC under 47 CFR Part 90. Our Part 90 application is currently pending under application number [FCC application number - pending].

LiDAR is an optical instrument and carries no FCC licensing requirement. Until the licence is granted we schedule laser-only work, and we will tell you plainly which instruments are on the job before you book it.

08Privacy of speed monitoring data

Residential and spot monitoring records vehicle speeds and traffic counts. We do not identify individual drivers, we do not photograph or record registration plates as part of a speed study, and we do not supply data to any enforcement body.

A speed study is delivered to the client who commissioned it. What that client does with it is their responsibility, not ours.

09Liability

To the fullest extent permitted by Texas law, our liability arising out of any engagement is limited to the fees paid for that engagement. We are not liable for indirect, incidental, or consequential losses, including fines, penalties, legal costs, insurance outcomes, or lost time arising from reliance on a report.
